1 1 Section 1. MOTOR VEHICLE EMISSIONS INTERIM STUDY. The

1 2 legislative council is requested to establish an interim study

1 3 committee to examine motor vehicle emission standards

1 4 including whether adoption of the California motor vehicle

1 5 emissions standards is a best practice for the state of Iowa,

1 6 how to increase the fuel efficiency of motor vehicles in the

1 7 state, and what the consumer cost savings are related to

1 8 increasing the fuel efficiency of motor vehicles in the state.

1 9 The interim study committee should develop a state directive

1 10 aimed at adopting motor vehicle emission standards that exceed

1 11 federal standards and making Iowa a national leader in low

1 12 usage of carbon fuels. The committee shall be composed of ten

1 13 members, representing both political parties and both houses

1 14 of the general assembly. Five members shall be members of the

1 15 senate, three of whom shall be appointed by the majority

1 16 leader of the senate and two of whom shall be appointed by the

1 17 minority leader of the senate. The other five members shall

1 18 be members of the house of representatives, three of whom

1 19 shall be appointed by the speaker of the house of

1 20 representatives, and two of whom shall be appointed by the

1 21 minority leader of the house of representatives. The

1 22 committee shall issue a report of its recommendations to the

1 23 general assembly by January 15, 2010.

1 24 Sec. 2. FEASIBILITY STUDY. The office of energy

1 25 independence shall conduct a feasibility study to assess the

1 26 cost savings if Iowa were to adopt the California motor

1 27 vehicle emissions standards or corporate average fuel economy

1 28 standards that are more stringent than those adopted by the

1 29 national highway traffic safety administration. The office

1 30 shall submit the findings of the study to the general assembly

1 31 by October 1, 2009.

1 32 Sec. 3. LOW CARBON FUEL STANDARDS STUDY. The office of

1 33 energy independence shall conduct a study to assess and make

1 34 recommendations regarding the adoption of a low carbon fuel

1 35 standard. The office shall submit the findings of the study

2 2 EXPLANATION

2 3 This bill relates to motor vehicle emission standards.

2 4 The bill requests the legislative council to establish an

2 5 interim study committee to examine motor vehicle emission

2 6 standards.

2 7 The bill requires the office of energy independence to

2 8 conduct a feasibility study to assess the cost savings if Iowa

2 9 were to adopt the California motor vehicle emissions standards

1 1 Section 1. NEW SECTION. 15.296 LEAD CONTAINMENT AND

1 2 ABATEMENT EQUIPMENT FUND AND PROGRAM.

1 3 1. A lead containment and abatement equipment fund is

1 4 created in the state treasury under the control of the

1 5 department of economic development consisting of the

1 6 following:

1 7 a. The moneys appropriated to the department for deposit

1 8 in the fund.

1 9 b. Payments of interest, repayments of moneys loaned, and

1 10 recaptures of grants and loans made pursuant to this section.

1 11 c. Moneys credited to the fund are not subject to section

1 12 8.33. Notwithstanding section 12C.7, interest or earnings on

1 13 moneys in the fund shall be credited to the fund.

1 14 2. The department shall establish and administer a lead

1 15 containment and abatement equipment program for purposes of

1 16 providing financial assistance to applicants from the lead

1 17 containment and abatement equipment fund. Financial

1 18 assistance awarded under the program may include grants,

1 19 loans, or forgivable loans.

1 20 3. a. Awards of financial assistance pursuant to this

1 21 section shall be in an amount equal to fifty percent of the

1 22 cost incurred in the purchase of lead containment and

1 23 abatement equipment. However, an applicant shall not receive

1 24 assistance in an amount greater than two thousand dollars.

1 25 b. To be eligible to receive financial assistance pursuant

1 26 to this section, an applicant shall be certified as a lead

1 27 abater pursuant to section 135.105A and shall have

1 28 successfully completed a lead abatement contractor course.

1 29 c. In administering the program described in this section,

1 30 the department shall encourage minority persons and

1 31 minority=owned businesses to apply. For purposes of this

1 32 paragraph, "minority person" means the same as defined in

1 33 section 15.102, subsection 7.

1 34 4. The department may adopt rules pursuant to chapter 17A

1 35 for the administration of this section.

2 1 Sec. 2. APPROPRIATION == LEAD CONTAINMENT AND ABATEMENT

2 2 EQUIPMENT PROGRAM. There is appropriated from the general

2 3 fund of the state to the department of economic development

2 4 for deposit in the lead containment and abatement equipment

2 5 fund for the fiscal year beginning July 1, 2009, and ending

2 6 June 30, 2010, the following amount, or so much thereof as is

2 7 necessary, to be used for the purposes designated:

2 8 For providing financial assistance to applicants under the

2 9 lead containment and abatement equipment program created in

2 10 section 15.296, as enacted in this Act:

2 11 .................................................. $ 50,000

2 12 EXPLANATION

2 13 This bill establishes a lead containment and abatement

2 14 equipment fund and program. The purpose of the program is to

2 15 make awards of financial assistance from the fund to

2 16 applicants. To be eligible, an applicant must be certified as

2 17 a lead abater and have successfully completed a lead abatement

2 18 contractor course. Applicants who are eligible qualify for a

2 19 grant or loan in the amount of 50 percent of the cost of lead

2 20 containment and abatement equipment, not to exceed $2,000.

2 21 The bill appropriates $50,000 to the lead containment and

2 22 abatement equipment fund for purposes of providing awards of

2 23 financial assistance under the program.
