MEETING MINUTES, April 20, 2015
Meeting called to order at 7:00 p.m. and Meeting convened.
ROLL CALL: Present: James Waskovich, Ken Horner, Paritosh Desai, Anthony Garaguso, Doug Totten, Roger Gravatt, Brian Williams (Alt. 1) and Alfred Mottola. Also in attendance: Glenn Gerken, Engineer and Michael Steib, Attorney and Susan Babbitt, Secretary/Administrator.
Compliance Statement was read.
Motion was offered by Al Mottola, seconded by Tosh Desai to approve the February 23, 2015 minutes and motion carried.
Motion was offered by Doug Totten, seconded by Anthony Garaguso to adopt the Anthony Arroyo Resolution and roll call vote showed unanimous approval.
Motion was offered by Ken Horner, seconded by Al Mottola to adopt the Terry and Vincent Sajkowski Resolution and roll call vote showed unanimous approval.
Christopher Kopacz, Z15-4, B16, L5.02, 62 Yellow Meetinghouse Road was presented for bulk variance approval. Bob Munoz, applicant's attorney, presented proof of service and publication and Mr. Steib stated Board had jurisdiction to proceed. Exhibits were marked in and witnesses sworn in. Chris Kopacz stated he is the second owner and has lived there since 2010. The home was already constructed when he moved in and he received survey from realtor. Mr. Munoz stated that this is a corrective variance as it existed when Mr. Kopacz purchased the home (unknowingly at the time). Frank Sadeghi, Engineer, reviewed these plans with the board stating that the side setback is 7 ft. into the allowable 40' side setback. Glenn Gerken concurred with this and stated that it would appear that perhaps the control used when laying out some of the structures after subdivision approval was off thus creating this variance situation. So, as it stands now 33 feet is provided for side setback where 40 feet is required. Board members discussed this and understand it is corrective in nature.
The hearing was opened to the public, no comments and declared closed.
Motion was then offered by Roger Gravatt, seconded by Tosh Desai to approve this side yard setback bulk variance and roll call vote showed unanimous approval.
Eric DeRose, Z15-5, 1 Fieldstone Ct., B32, L4.36 was presented for bulk variance approval. Proof of service and publication was presented to Mr. Steib and he stated the board had jurisdiction to proceed. Exhibits were marked in. Mr. DeRose described this property stating that this is the oldest home in Upper Freehold Township and that they hired a historic Architect to help them plan this proposed 1 and 1/2 story addition to the home and explained why the addition had to go in this location where the foundation is in good shape while keeping the historic fabric of home. Approximately 30% of the new addition crosses over the (side) line setback, hence the need for bulk variance--75' required, 64' offered. (Since this is on cul-de-sac and part of 9 lot subdivision, they have to comply with front yard setback regulations.)Board members and Engineer, Glenn Gerken reviewed these plans and the architectural plans indicate that the proposed addition will be approximately 594 sq. ft. and is located on the easterly side of the house and basically squares off that side of the house.
After continued board discussion, the public hearing was declared open; there were no comments and the hearing was declared closed.
Motion was then offered by Tosh Desai, seconded by Al Mottola to approve this bulk variance for front yard setback and roll call vote showed unanimous approval.
With no further business, the motion was made, seconded and unanimously approved to adjourn this meeting.
